This Policy governs the right of withdrawal, product return procedures and refunds relating to purchases made on www.hera-sport.it, the trading name of the online store operated by SIRIO BARBARA MARIA.
1. Right of withdrawal
Pursuant to Articles 52 et seq. of Italian Legislative Decree 206/2005 (Consumer Code), customers acting as consumers have the right to withdraw from the contract, without giving any reason, within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Where a single order covers multiple goods delivered separately, the withdrawal period runs from the day on which the consumer acquires physical possession of the last item.
The right of withdrawal is available exclusively to consumers, in the cases and within the limits provided by applicable law.
2. How to exercise the right of withdrawal
To exercise the right of withdrawal, the consumer must inform Hera Sport of the decision to withdraw from the contract by means of an unequivocal statement sent before the 14-day withdrawal period expires.
To facilitate processing, the communication to Customer Service may include:
order number;
first and last name;
products concerned;
a clear statement of the intention to withdraw from the contract.
The consumer may also use the model withdrawal form provided by applicable law, although this is not mandatory. Customer Service will provide operational instructions for returning the goods.
3. Returning products
The consumer must return or send the products without undue delay and in any event no later than 14 days from the date on which the decision to withdraw was communicated. The deadline is met if the goods are sent before the 14-day period expires.
Products should be returned complete with their accessories and, where reasonably possible, their original packaging.
The consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Any such diminished value may therefore result in a corresponding reduction of the refund, within the limits permitted by law.
4. Return shipping costs
Unless Hera Sport expressly states otherwise, the direct cost of returning products following exercise of the right of withdrawal is borne by the consumer.
The use of a trackable shipping method and suitable packaging to protect the products during return transportation is recommended.
5. Inspection of returned goods
Once the returned products have been received, Hera Sport will inspect their condition in order to determine whether there has been any diminished value resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
This inspection does not restrict the consumer’s statutory right of withdrawal.
6. Refund
Where the right of withdrawal has been validly exercised, Hera Sport will reimburse all payments received from the consumer in relation to the products concerned, including standard delivery costs, without undue delay and in any event no later than 14 days from the day on which Hera Sport is informed of the consumer’s decision to withdraw from the contract.
If the consumer selected a delivery method that is different from and more expensive than the least expensive standard delivery method offered by Hera Sport, the additional delivery costs will not be reimbursed.
The refund will be made using the same means of payment used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise and provided that the consumer does not incur any fees as a result of the reimbursement.
Hera Sport may withhold reimbursement until it has received the goods back or until the consumer has supplied evidence of having sent the goods back, whichever occurs first.
7. Products excluded from the right of withdrawal
The right of withdrawal does not apply in the cases provided for by Article 59 of the Italian Consumer Code. For products sold on the Website, the exclusions may in particular include:
goods made to the consumer’s specifications or clearly personalized, including products personalized by engraving, printing or embroidery;
products manufactured according to individual specifications requested by the customer;
sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
The mere fact that a product is not held in stock and is specifically ordered by Hera Sport from a manufacturer does not, in itself, exclude the right of withdrawal where the product is standard and has not been made to the consumer’s specifications or clearly personalized.
8. Examples of products that may be excluded
By way of example, where the statutory conditions are actually met, the exclusion may apply to:
twirling batons personalized by engraving or other processing requested by the customer;
uniforms, garments or accessories personalized by printing, embroidery or manufacture to individual specifications;
spare parts specifically manufactured according to the customer’s instructions;
majorette boots or other items made to measure or according to the customer’s individual specifications;
tights, underwear and other sealed products unsuitable for return for health protection or hygiene reasons where the seal has been removed after delivery.
Where applicable, the exclusion from the right of withdrawal will be indicated in the product information or otherwise before the purchase is concluded.
9. Incorrect, damaged or defective products and legal guarantee
If the customer receives a product different from the one ordered, a damaged product or a product affected by a lack of conformity, the customer is invited to contact Customer Service as soon as possible, providing the order number and a description of the issue. Photographs of the product and, where relevant, its packaging may be requested where useful for assessment.
Consumers benefit from the statutory legal guarantee of conformity provided for by Articles 128 et seq. of the Italian Consumer Code. In the cases and under the conditions provided by law, consumers are entitled to the statutory remedies, including repair or replacement and, where the relevant requirements are met, a proportionate price reduction or termination of the contract.
Nothing in this Policy limits or replaces the consumer’s rights under the statutory legal guarantee of conformity.
