This Warranty Policy governs the Legal Guarantee of Conformity, any commercial warranties offered by manufacturers and the procedures for handling support requests relating to products purchased on the website www.hera-sport.it.
1. Legal Guarantee of Conformity
For all purchases made by consumers, the Legal Guarantee of Conformity provided for by Articles 128 et seq. of Italian Legislative Decree 206/2005 (Consumer Code), as amended by Legislative Decree 170/2021, shall apply.
The warranty exclusively covers lack of conformity existing at the time of delivery of the product and which becomes apparent within the time limits provided for by applicable legislation.
The consumer is entitled, free of charge, to have the goods brought into conformity by repair or replacement or, in the cases provided for by law, to a price reduction or termination of the contract.
2. Professional customers (B2B)
For purchases made by professionals, businesses or associations, the provisions of the Italian Civil Code and any contractual agreements entered into between the parties shall apply.
3. Defective or non-conforming products
If the customer receives a product that is:
damaged;
defective;
non-conforming;
different from the one ordered,
they are invited to contact Customer Service as soon as possible, attaching:
order number;
detailed description of the problem;
photographs of the product;
photographs of the packaging, where relevant.
Hera Sport will examine the report and, if the defect is confirmed, will propose the solution provided for by applicable legislation.
4. Available remedies
Depending on the nature of the defect, the following remedies may be provided:
repair;
replacement;
full or partial refund;
another remedy provided for by applicable legislation.
The remedy will be selected in accordance with applicable legislation and the circumstances of the case.
5. What is not covered by the warranty
The warranty does not cover defects or damage resulting from:
improper use of the product;
use not in accordance with its intended purpose;
impacts;
falls;
normal wear and tear;
improper maintenance;
modifications made by the customer;
repairs carried out by unauthorized personnel;
failure to comply with the manufacturer's instructions.
6. Use of products
The products marketed by Hera Sport are intended for sports, educational, recreational or professional activities, depending on the characteristics of each item.
The user is required to follow any instructions provided by the manufacturer and to use the products in accordance with normal safety rules.
Sporting activities, by their very nature, involve a degree of risk that cannot be eliminated solely through the quality of the equipment used.
7. Choice of size
The customer is responsible for choosing the most suitable size of the products purchased.
Hera Sport provides size guides, technical descriptions and pre-sales assistance to help the customer make their choice.
For custom-made or personalized products, it will not be possible to request size changes once production has begun.
8. Manufacturer's commercial warranty
Some products may be covered by a commercial warranty offered directly by the manufacturer.
This warranty:
is optional;
is independent of the Legal Guarantee of Conformity;
does not in any way limit the rights granted to consumers by law.
The terms and conditions of the commercial warranty are established exclusively by the manufacturer and may vary depending on the brand and product.
9. Exclusions of liability
Hera Sport shall not be held liable for damage resulting from:
improper use of the products;
use not in accordance with the intended purpose;
modifications made by the user;
incorrect installation;
lack of maintenance;
normal wear and tear;
use by persons without adequate technical training;
failure to comply with the manufacturer's instructions.
This clause does not limit the mandatory rights granted to consumers by applicable legislation.
10. Wear and tear resulting from sporting activities
Products intended for sporting activities are designed to withstand intensive use but are subject to normal wear and tear resulting from use.
Scratches, abrasions, discoloration, impact marks, surface deterioration or other effects resulting from normal use during training, competitions, performances or transportation do not constitute a lack of conformity and are not covered by the Legal Guarantee, unless they result from an original defect in the product.
11. Assistance
To speed up the handling of warranty requests, it is recommended to retain:
order confirmation;
invoice or receipt;
any manufacturer documentation.
Proof of purchase may be required to verify the applicability of the warranty.
